Acceptable Use Policy


By using CSOnline for your Internet access, you agree that your use of the service and your access to the Internet is provided with your agreement to abide by these following terms and conditions.

You agree CSOnline may revise the terms and conditions of this Agreement and revise the services provided under this Agreement at any time. Any such revisions will be binding and effective immediately on posting the revised Agreement on www.csonline.net/cats/terms web site, or on notification to you by e-mail or United States mail.

You agree to review the Agreement periodically to be aware of any such revisions. If any revision to this Agreement is unacceptable to you, you may terminate this Agreement at any time by contacting Alltel at 814-226-2452 or 877-519-CATS.  Notice of your termination will be effective on notification by Alltel.

You agree that, by continuing to use the Access Service following notice of any revision to the Agreement, you accept any such revisions and agree to abide by any such revisions.

You agree CSOnline reserves the right to distribute informative emails to our subscribers on an ad hoc basis that it feels is pertinent to the quality of our service. These announcements are predominately informative in nature and often provide our subscribers with notification describing changes, upgrades, and other critical information pertaining to this evolving medium.

CSOnline will not release your personal information or your billing information, to any third party except upon presentation of a valid court order or government entity within our jurisdiction. You agree that our judgement as to the validity of any court order or subpoena shall be considered proper and final.

CSOnline will not sell its mailing list to other companies, nor will it release subscriber database information without your explicit and written authorization, except as specifically provided for in this agreement.

This agreement supersedes any written or oral communication you may have had with CSOnline or Alltel, and is the complete and total agreement between you and CSOnline/Alltel.

You agree that, if any portion of this Agreement or CSOnline’s Policies is held invalid or unenforceable, that portion will be construed consistent with applicable law as nearly as possible to reflect the original intentions of the parties, and the remaining portions will remain in full force and effect. The Agreement will be governed by the laws of The Commonwealth of Pennsylvania, excluding its conflicts of law rules. You and CSOnline each submit to the exclusive subject matter jurisdiction, personal jurisdiction, and venue of the courts of the Commonwealth of Pennsylvania.

Violation of any of the terms and conditions of this agreement may result in the immediate, without notice cancellation of your subscription and the forfeiture of your remaining subscription fee. Serious violations may subject you to criminal or civil prosecution.

Registration Information:

You agree to provide Alltel with complete and accurate registration information. To notify Alltel within 5 business days of any changes to your account information. Should you not provide Alltel with accurate registration information your account may be terminated immediately.

You agree that you are at least eighteen years old and that you are legally able to enter into this agreement.

Internet Access Service:

CSOnline’s Internet service will provide you with unlimited access to the Internet through CSOnline’s Internet service.  CSOnline has no cancellation fees on dial-up accounts and provides free customer technical phone support to address connectivity difficulties.

The term "Unlimited access" is defined as unrestricted access to the Internet and the data on the Internet, and does not grant a user the right to keep a dial-up connection up 24 hours a day/7 days a week. Online time is monitored and if the account is being abused, the user will be charged for dedicated access.

You agree to remain connected to CSOnline only when actually using your personal account and are to disconnect when idle for significant periods of time. You also agree not to use any software or hardware method to defeat any idle time limits that may be applied now or in the future. CSOnline has the right to enforce this restriction using any appropriate means.

Your billing cycle with Alltel starts with the activation of your account.

You are responsible for verifying that the phone number you are calling the Internet through CSOnline is a local access number to which your computer is dialing. Any telephone charges associated with your access to the Internet through CSOnline are solely your responsibility. CSONLINE DOES NOT REIMBURSE OR PAY ANY TELEPHONE CHARGES FOR ANY REASON.

You agree that CSOnline personal accounts are for your personal use only. Loaning or giving your password to others, permitting another party to use your account, using any method to place more than one Computer System on your ethernet network connection or any form of resale of your connection is prohibited. CSOnline sells commercial accounts for those that require multiple accounts, multiple users or commercial connectivity as well as personal accounts. Please contact our storefront at 814-226-2452 or 877-519-CATS if you require a commercial account. CSOnline commercial account Terms of Service are included in the commercial account contract.

The security of your account, including any information or data received or transmitted through it, is your responsibility. Should you believe the security of your account has been compromised in any way, it is your responsibility to notify CSOnline immediately via telephone and in written form. You are responsible for any and all use of your account until CSOnline has been notified of a security problem.

CSOnline retains the right, but not the obligation, to restrict or terminate your account at any time, if CSOnline in its sole discretion, determines that you are in violation of this Agreement. Should CSOnline determine that you are in violation of this Agreement, any restriction or termination of your Internet service will be effective immediately, without prior notice. CSOnline/Alltel will have no liability to you for any restriction or termination of your account pursuant to such violation. CSOnline is not responsible for the contents of your mailbox, any personal storage, or other materials in your account at the termination of your subscription regardless of the cause of that termination.

You understand the Internet is not owned, operated, or managed by, or in any way affiliated with CSOnline or any of CSOnline’s affiliates. The Internet is an international computer network of both Federal and non-Federal inter-operable data networks. CSOnline cannot and will not guarantee that the Internet service will provide Internet access that is sufficient to meet your needs. You agree that your use of the Internet service and the Internet is solely at your own risk and is subject to all applicable local, state, national and international laws and regulations.

Internet Service Restrictions:

You agree that information or data passed via CSOnline to or from other networks will comply with the other networks terms of service rules and regulations.

You agree not to obstruct the systems identification or to alter systems identification information in any way to hide or deceive the source of the communications.

You agree CSOnline services will be used only for lawful purposes. Transmission of or solicitation for reception of any material which violates Pennsylvania or US Federal law, Local ordinance, or laws governing the locality where you reside is prohibited. This includes, but not limited to, material which is legally obscene, threatening, libelous or violates any provision of intellectual-property law including copyright, trade-secret, or patent laws

You agree that CSOnline reserves the right to immediately block access to any or all services from your account should CSOnline, at it's sole discretion, determine that the use of those services from your account has been damaging either to the Internet community or to the Internet itself.

You understand that transmission of mass unsolicited commercial or personal electronic mail (aka spam), and Usenet postings to inappropriate groups, regardless of content is explicitly prohibited by CSOnline. You agree not to Post or cross post the same unsolicited message to 5 or more newsgroups or email recipients.

Content:

The Internet service provides you access to information, communications, software, photos, video, graphics, music, sounds and other material and services located both on CSOnline's computer servers and on the Internet ("Content"). You agree that you must evaluate and bear the risks associated with the subject matter, accuracy, completeness or usefulness of any Content available to you on or through the Internet service.

You agree that CSOnline has the right, but not the obligation, to remove Content from CSOnline’s computer servers which CSOnline, in its sole discretion, determines to be in violation of this Agreement or CSOnline’s Online Policies.

As a matter of policy, CSOnline does not pre-screen Content placed on CSOnline’s computer servers by any of its subscribers. CSOnline does not have the practical ability to monitor, review, or restrict, prior to its transmission, Content on CSOnline’s servers which may violate this Agreement or CSOnline’s Online Policies. In addition, CSOnline cannot ensure the prompt editing or removal of any Content which may violate this Agreement or CSOnline's Online Policies after such Content has been posted on CSOnline's servers.

The Internet provides access to individuals who are not CSOnline subscribers. CSOnline does not have the capability to monitor, review, or restrict any Content made available by third parties on the Internet, nor to edit or remove any such Content after its posting on the Internet.

Please be advised that, despite CSOnline's efforts, you may receive Content which you consider to be inaccurate, defamatory, or otherwise offensive. You agree that CSOnline will not be liable for any action or inaction with respect to any Content posted on or through the Internet.

No Warranty:

You agree that your use of the Internet is solely at your own risk. You agree that the Internet Service is on an "as is," "as available" basis without warranties of any kind, either express or implied, unless such warranties are legally incapable of exclusion.

CSOnline disclaims any and all loss or liability resulting from, but not limited to: (1) loss of data; (2) loss of software or hardware; (3) loss or liability resulting from access delays or access interruptions; (4) loss or liability resulting from computer viruses; (5) loss or liability resulting from data non-delivery or data mis-delivery; (6) any other loss or liability resulting from the negligent acts and/or omissions of CSOnline or CSOnline’ subscribers; (7) loss and liability resulting from any errors, omissions, or misstatements in any and all information, goods, or services obtained on or through the Internet Service, and; (8) loss or liability resulting from acts of God.

You agree that CSOnline’s entire liability, and your exclusive remedy, with respect to your use of the Internet, your use of the Internet Service Software, and any breach of this Agreement is solely limited to the amount you paid to use the Access Service. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states, CSOnline’s liability is limited to the extent permitted by law.

Indemnification:

You agree to defend, release, indemnify, and hold CSOnline, its affiliated companies and licensors, harmless from all liabilities, claims and expenses, including without limitation reasonable attorneys fees, arising from breach of the Agreement by use of, or in connection with the posting or transmission of any content by or through your account on the Internet.

You agree that CSOnline has the right, but not the obligation, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you pursuant to Paragraph 1 of this section. In such event, you shall have no further obligations pursuant to Paragraph 1 of this section.

Termination:

The relationship between you and CSOnline is intended to be mutually beneficial. Either of the parties can terminate this Agreement on an equitable basis (except for the Indemnification Section), for any reason at any time.

You agree that your only right with respect to any dissatisfaction with any Agreement term, policy, or practice of CSOnline in operating the Internet or Content available on or through the Internet or changes therein, or amount or type of fees, billing methods, or changes therein, is to terminate this Agreement as set forth in the first Paragraph of this section.

CSOnline has the right, but not the obligation, to delete all programs, data, or other files on our computer servers that are associated with your account at the time of your account's termination.

Only the person whose name is on the account will be able to

Change User ID and/or Password
Cancel an existing account
Some restrictions may apply to your selection of user id.

CSOnline Policies:

CSOnline’s dedication to customer service means that CSOnline strives to maintain Internet Service that will provide CSOnline customers with an enjoyable Internet experience, one that is free from interference from individuals and organizations that use Internet service in an inappropriate or unlawful manner.

CSOnline’s Online Policies will address frequently asked questions regarding proper online conduct. These policies include information on the Content of the Online Material that you may find on or through the Internet; purchasing Online Goods and Services through the Internet.

CSOnline's Online Policies, including the following list of Prohibited Activities, are part of your subscriber agreement. If you restrict or inhibit any other subscribers' use or enjoyment of the CSOnline’s Internet Service by engaging in any of the activities prohibited below, CSOnline may suspend or terminate your account as outlined in the Acceptable Use Policy.

As explained in the Acceptable Use Policy, your use of CSOnline’s Internet Access Service must be governed by all applicable laws and regulations, including all applicable local, state, national, and international laws and regulations. In addition to other applicable laws, this includes all laws relating to copyright, trademark, obscenity, defamation, the right of privacy, false advertising, and fraud.

Please use your best judgment, be respectful of other subscribers, and take the time to review the activities listed below. These activities are not proper Internet conduct and are prohibited activities on CSOnline’s Internet Service. Following these rules will ensure that everyone has an enjoyable Internet experience.

If the connection to CSOnline’s Internet service has no activity from the user for a period of 60 minutes, then CSOnline may disconnect services and end the session

PROHIBITED or ABUSE ACTIVITIES:

For this section the term "data" means any type of material capable of being posted, transmitted on or through CSOnline’s Internet Service including material in print, graphic or pictorial form.

When using CSOnline’s Internet Service you agree:

Not to post or transmit any obscene or sexually explicit images or other content on or through the Internet Service.

Not to use the Internet Service to harass, threaten, abuse, embarrass, or cause distress, unwanted attention, or discomfort to any person or entity, by any means, including the use of vulgar, hateful, racially, ethnically, or otherwise objectionable information.

Not use the Internet Service to impersonate any person, including but not limited to, an CSOnline official or an information provider, guide, or host, or communicate under a false name or a name that you are not entitled or authorized to use in all forms of online communication, including, but not limited to, screen names, subscriber profiles, chat dialogue, and message posting.

Not to use the Internet Service to disrupt the normal flow of online dialogue, or otherwise act in a manner that negatively affects other Subscribers, users, individuals, or entities.

Not to make false or unverified complaints against any CSOnline subscriber, or otherwise abuse any of CSOnline’s Internet services.

Not to abuse CSOnline’s system by causing any harm to the system so that it inhibits other users ability to effectively use the system.

Not to Post or cross post (SPAM), regardless of content, of the same unsolicited message to 5 or more newsgroups or email recipients.

COMMUNICATION PRIVACY:

CSOnline intends to respect its Subscribers' privacy and will not randomly monitor or disclose the contents of private e-mail or private chat room communications. However, you agree that CSOnline has the right, but not the obligation, to monitor or disclose the contents of private communication, if CSOnline, in its sole discretion, reasonably believes that such action is necessary, to comply with applicable law or valid legal process, to protect CSOnline’s rights or property or in emergencies when a person's physical safety is at issue.

ECPA NOTICE: CSOnline reserves the right to monitor any and all communications through or with CSOnline facilities. You agree that CSOnline is not considered a secure communications medium for the purposes of the ECPA, and that no expectation of privacy is afforded.

ONLINE CONTENT:

As mentioned in the Content section of the Acceptable Use Policy, CSOnline's Internet service provides access to information, visual, written, oral and other services located both on CSOnline’s computer servers and on the Internet. You should be aware this Internet Content may contain, goods and services that you may find improper, obscene, or otherwise offensive. Such Content may not be appropriate for you or for any minors who may be accessing the Internet through your account.

Accordingly, CSOnline cannot be responsible for any conduct, Content, goods, and services available on or through the Internet Service. CSOnline suggests that concerned parents consider using one of the commercially available programs capable of restricting access to sexually explicit material on the Internet. Links to companies that provide commercially available software capable of restricting access to sexually explicit material can be found on CSOnline’s Cyber Watch web site. However, no parental control software is perfect. Your use of such software is solely at your own risk. CSOnline makes no warranties or representations as to the accuracy, completeness, or usefulness of any parental control software or service.
